(i) Interfere with the website’s functionality.
(ii) Copy or steal content from our website.
(iii) Use automated systems (e.g. bots) to scrape data.
(b) We may suspend or block your access to our site if we believe you have breached these terms or misused our services.
(c) You must be at least 18 years old or have a parent or guardian's consent to place an order.
(d) We may update these Terms and Conditions from time to time. The latest version will always be published on our website. If changes are significant, we will notify you by email (if applicable) or on our homepage.
3. Product Information
(a) We do our best to ensure product descriptions, images and prices are accurate, but we can't guarantee there won't be occasional errors. Colours and sizes may appear differently depending on your screen or device.
(b) We reserve the right to:
(i) Correct errors or omissions.
(ii) Change product details, availability or pricing at any time.
(iii) Cancel an order where information has been incorrectly displayed.
4. Orders and Payments
(a) Orders are placed by following the checkout process on our website. You will receive a confirmation email once your order is received. This does not mean your order is accepted.
(b) A binding agreement is formed only once your order is processed and dispatched.
(a) We accept payment via the methods listed at checkout. All orders must be paid in full at the time of purchase.
(b) If we cannot fulfil your order for any reason (e.g. stock unavailability or pricing error), we will contact you as soon as possible and issue a refund to your original payment method.
2. Shipping and Delivery
(a) We deliver Australia-wide using standard and express delivery options. Shipping fees and estimated delivery times are shown at checkout.
(b) Once your order is shipped, we are not responsible for delays caused by third-party couriers.
(c) Risk of loss or damage passes to you when the goods are delivered. If you provide authority to leave parcels unattended, you accept full responsibility for any lost or stolen items.
(d) If a parcel is returned to us due to incorrect address or failure to collect, re-delivery fees may apply.
3. Returns and Exchanges
6.1 Faulty Items
(a) If you receive a faulty, damaged or incorrect item, please contact us within 14 days of delivery. We will either:
(i) Replace the item (if available)
(ii) Repair it; or
(iii) Provide a full refund in line with your rights under the Australian Consumer Law.
(b) We will require photos or evidence before issuing a return label.
6.2 Change of Mind Returns
(a) You may return items for change of mind within 7 days of receiving your order, provided:
(i) the item is unworn, unwashed and in original condition.
(ii) all original tags and packaging are intact.
(iii) the item is not a final sale or excluded item (e.g. underwear, earrings, swimwear).
(b) You are responsible for return postage unless the item is faulty.
(c) Once we receive and inspect the returned item, we will process:
(i) a refund to your original payment method, or
(ii) a store credit, depending on your preference.
7. Dispute Resolution
(a) If you are dissatisfied with any of our goods, you must notify us in writing within 7 days of the event or service date by email to: the.official.lume@gmail.com
(b) We will assess the complaint and respond within 14 days by way of reply to the email LUMÉ was notified of the complaint by.
(c) If a compliant cannot be resolved, the parties agree to engage in conciliation before any court proceedings can be commenced.
8. Promo Codes and Gift Cards
(a) Promo codes are for one-time use only and must be used before their expiry date. They cannot be transferred or exchanged for cash.
(b) Gift cards are valid for 3 years from the date of purchase. Lost or stolen gift cards cannot be replaced.
(c) Gift cards and promo codes cannot be used to buy additional gift cards or be combined with other discount codes.
9. Limitation of Liability
(a) To the extent permitted by law, we are not liable for any loss, damage or injury resulting from:
(i) Your use of or inability to use the website.
(ii) Delays in delivery.
(iii) Product misuse or failure to follow care instructions.
(b) Your rights under the Australian Consumer Law are not affected by these terms.
10. Intellectual Property
(a) All content on this site (including logos, images, text and design) is the property of LUMÉ or its licensors.
(b) You may not copy, distribute or use our content without written permission.
11. Privacy
(a) We are committed to protecting your privacy. Any personal information collected is handled in accordance with our Privacy Policy and the Australian Privacy Principles.
12. Account Security
(a) If you create an account with us, you are responsible for maintaining the confidentiality of your login details and for all activity on your account.
(b) We may suspend or cancel your account if we believe it is being used fraudulently or in breach of our terms.
13. Jurisdiction
(a) This agreement is governed by the laws of New South Wales, Australia. The parties submit to the exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.
